I dunno where I stand on this one. One the one hand, the idiot didn't hit the thieves, and instead managed to wound someone he wasn't shooting at. Yeah, that's bad, and he probably should lose the right to own a gun at a minimum, maybe serve some time in prison. I'll echo the guy below who pointed out that if the thieves had shot at him, the charges would undoubtedly be milder.
I get that shooting at someone over a few bags of chips or whatever is "immoral" in that human life is somehow sacred, no matter how heinous the crime that human life commits. I also get that theft isn't that serious. We pretty much all tried to shoplift something when we were kids (I got caught, but was only made to pay for it). That being said, I keep repeating: the way we're going, we're essentially legalizing theft, and that legalization is going to have bad consequences, even short term. San Francisco is going to be a ghost town in a few years. The offices are emptying out and the shops and restaurants are closing, mostly because of theft and violent assaults. If you're not a professional cop or whatever, it's a bit much to expect someone to only properly escalate force according to some scale, where you have to wait for the other guy to do something in order for you to retaliate. If he pulls a knife and is close enough to you, you can shoot him (provided you live somewhere where you can legally carry one) but only of course if he doesn't stab you to death first.
I don't think the guy here acted appropriately, in that he left his "cage" in order to confront these guys. However, every solution I can come up with to this situation involves the store owner spending money to upgrade the security measures…and in my mind he shouldn't have to. Not everyone leads a 9-5 life and can afford to do all their shopping during the day, leaving the night to punks who have nowhere to rob because nothing's open. The streets, and our world, need to be a lot safer than they are. I don't think this guy found the right solution; I also don't think legalizing theft (which is essentially what we're doing) is the solution either.

The clerk had "no intention to murder" the bystander so it will be not guilty, unless they wise up and change it to negligent discharge of a weapon, or something similar. Intent, intent, and intent is always the key. That clerk needs to go to a shooting range, and practice.

I imagine the attempted murder charge relates to attempting to shoot the fleeing shoplifters, not hitting the innocent man, per se. Since the shoplifters didn't pose a lethal threat (per the law) shooting at them was not legal. He probably could have been charged with attempted murder even if the innocent man wasn't hit, if the authorities had found out.
