Car is a deadly weapon just like a gun. If you got robbed at gunpoint they're a deadly threat until stopped. Any sane person would've shot them it's no different.
Well… it's a gray area, but an incapacitated attacker is still less dangerous than one who can still change his mind and return to attack again. If they ran, they might have feared that they would be pursued, even with the getaway car? Possibly? Or perhaps they feared for the passenger who would still be in danger if they had just driven off? I can understand why they would try to fight rather than run away. Although from a rational, global perspective, driving off would probably have been the safer move.
I can also imagine, though, that you're not quite thinking clearly in that situation. If you have just fought with this guy for your life over their gun, I can imagine you could get tunnel vision and only focus on incapacitating the threat rather than taking a step back and reevaluating what would be the smartest move from a rational perspective. So I do understand why the authorities wouldn't give this guy any trouble for this decision. Sure, he didn't have a lot of justification, but he had some, and you don't need a lot to justify force against an attacker.
i think that it was well deserved. that is protection, the driver had no idea if he had intention to use the gun again. and turns out he did… just on himself
An attacker is armed and amped up so stopping that offender is still a moral obligation which he did conclusively and definitively . And my defence would be :- He attacked me then ran towards another car brandishing a gun so I terminated that potential danger ? !
Laws need to focus on the mental health of the victim. The law and all these old retards think its okay for a criminal to physically and emotionally scar people for their entire lives for their own gratification but if you react in the moment you get in trouble. Sorry but most people think society's laws are dog shit and natures laws are much more efficient and effective.
Well I’m from Chicago and the way I see it it’s justified… who’s to say this dude wasn’t going back to the car to get the chopper and spray out that car? In Chicago you literally get chased around in cars while being shot at, so just because he gets in the car doesn’t mean he no longer posses a threat. Especially if you are unarmed. Matter of fact in my eyes he posses a bigger threat with his vehicle bc they usually have multiple rifles in the car + cover. And if not, many times they’ll look for you later with more firepower.
Crime doesn't pay and it might cost you your life. Defenders shouldn't run people over, but the driver protected people in the car and the diner. I didn't think about using a car as a self defense weapon, but it makes sense in the moment.

The victim may not have seen the perp trying to enter the getaway car, and, as far as I'm concerned, he still posed a deadly threat.
