seeing some of the damn comments it seems some of these people beleive that if a woman is being raped or an older person mugged or just a generally weaker victim being hurt by a stronger more capable attacker they should roll over and die or I even read grab a stick or a brick well let's for the sake of argument assume one of those is even in reach if you're a 120 lb woman who has never had any training or even been in a fight being assaulted by a 280 lb man you won't have to much chance even with that stick or brick same goes for and 80 year old man against a 20 year old thug it's a no win for the victim but that's fine as long as public order is kept right because if that woman or old man had pepper spray or a knife or god forebid a pistol to even it out then that "innocent" little fucker that decided to hurt somebody might not slip away into the night to do it again and if all those who prey on the weak knew that everytime they grabbed that woman or pulled a knife on that old couple they may catch a blade or a bullet for their trouble they may just start thinkin twice sorry for the rant I'm done now

HunterHerne says:

The thief thing happened a long time prior to the 2011 court case, or so I believe, as I remember talking about it in a high school sociology class (2003).  The law at the time supported the charges, but it did result in the laws being changed to better support citizens arrest.

On the Dwelling house, it's pretty much anywhere a person lives.  In the 1997 case R v. Feeney, Police investigating a murder entered an equipment shed, and found Mr. Feeney asleep, covered in blood.

He was charged, and convicted, but it was eventually decided the entry and arrest were unlawful, as Feeney had been living there, making it a dwelling, and the Officers did not believe an issue existed to allow them to enter a dwelling.

I don't know about weapons in Europe, but in Canada, under most circumstances a person can carry a weapon as long as it is not concealed.  For firearms, a license can be attained to carry small arms, again, only if not concealed.  Reasonable force has to be practiced either way, and most weapons only apply at the higher end of the scale.

(I have studied some of these things in school, as I work in a related field)

Fuzzy Dunlop says:

One difference between the US and Europe in terms of 'self-defense', you usually can get away with shooting someone as long as they're black. Not a fan, but it seems like the rule.

Maiq The Liar VII says:

Basically if you knock an attacker out then pull out a knife and slit his throat that is murder.

Ronin Snow says:

Lawful dwelling mean basically here in the UK that you're not a squatter who beats the property owner making lawful forceful entry.

Just some guy says:

because the governments are destroying us making us weak and to scared and inexperienced to defend ourselves they have made us weak this is how Zionism works. there will be a time where where our country will be attempted to be taken. it's a plot to destroy us and it's working when the day comes where genocides will be out of control we won't be able to stop it especially by hardened war experienced fighters from the middle East but it's not so much them you need to worry about . eyes on Israel and the protocols of zion read in the 1950s audio book

Lloyd Zed says:

Once I came home to discover there had been a brake in I don't know why but just in case the burglar was still there I picked up my crossbow and loaded it luckily for me he was not still there but to this day I actually didn't know whether that was legal or not lol

Eventually I got most of my stuff back as the idiot decided to try to sell my stuff on eBay

Jamal Swiss says:

MILKWynn says:

Better learn some basic law. Its quite important and useful as you might think. Im learning basic law in uni and it open up my mind alot. It really differentiate certain actions and past cases that are similar are law. Say for example. This case was similar to the case of john v dave (1993) for example, the verdict will be the same made for the current case as the last time because the case were similar or the same. There are factors to classify the differences between assault ( threatening without physical touch) and battery (physical touch). Law is pretty dry and plenty to remember but its very important and useful to learn. False imprisonment was also mentioned in the video because the shop keeper detained the thief without consents. But why the charges was drop because its was a lawful detention(meaning the police were notified and called in immediately). If they detained the thief and detain him for 10 hrs then called the police. It will be a different story and this is considered as false imprisonment.

the Gild - Hamilton, Canada Chapter says:

I just self represented and one by a landslide in my appeal. I had the opposition on many counts of perjury and rape and torture . . . then when the judge came out to read the verdict . . .he dicided to ignore the new evidence and ruled agaqinst me . . .rape and pedophilia is legal in Canada . . .standing up against it lands you in Mental institution for life to be a lab rat and raped and tortured for the rest of your life.

the Gild - Hamilton, Canada Chapter says:

I'm doing a life sentence for having screw drivers on me for self defence because I was being hunted like a dog by human trafficers . . .you must must love rape and sex slavery in Canada and if someone wants to kill you . . .you must let them or life in a cage!

the Gild - Hamilton, Canada Chapter says:

common sense is illegal in Canada

the Gild - Hamilton, Canada Chapter says:

my father came at me with a Fire place poker with kill kill kill in his eyes . . . I ran and grabs a sword downstairs . . .he ran to the car and left . . .then 5 minue=tes later the cops surrounded my house with machine guns and a 6-7 hour stand off happened, then I got charged with assault with a weapon and was forced to plead guilty or sit in jail for 6 months waiting for trial . . .Canada is fucked!

xxBOUNTYxxHUNTER says:

More truth than a myth tbh. Just because it says on paper you can defend your self, doesn't mean irl scenario you can't get fucked over by the law and put in jail because you defended your self. Our law here in the UK is just fucking retarded. Agree with you on most points tho.

6:43 Even though they were found Not Guilty, the time, expense, personal and family stress, public humiliation and loss of income from being prosecuted is punishment enough.
8:01 You'll be investigated (even in Castle Doctrine states). Then maybe (or maybe not) you'll be charged.

David Yi says:

What if I didn't start carrying a pocket knife for self-defense, but suddenly someone try to rob me on the street one day, can I use it? It is a tool for me at first, but can it also be the "weapon" I pick up reasonable at that specific moment? In my opinion, laws shouldn't include stuffs about people's thought because there's no way to proof, otherwise it ends up with robbers suiting the victim.

Jordan Prince says:

To me, the only way to ensure a attack is over is if they are dead or paralized.

Steve Neiman says:

I have a lot of respect for you having the courage to admit that you made a mistake and trying to fix it.
One thing I think you might be missing: The intent of a device might not change the results of using it (someone killed with a gun or a brass knuckle is no more dead than someone killed with a hammer or a lead pipe), but it does change the mindset of the person who owns it. If someone carries a firearm with them, they are constantly reminded of the fact that there are people who are dangerous enough that it can seem reasonable to have a device intended to kill them. For a certain kind of person, that can make them more likely to make use of such a device. Also, in the US the leading cause of firearm death is suicide and not homicide, by a wide margin, so making it harder to get access to firearms can be about protecting the buyer as well as everyone else.
That said, restricting nonlethal weapons like pepper spray or tasers is just stupid.

I'll have to argue with you on one point somebody broke into a person's house in California then upon exiting the property they slipped from the top of the fence broke their leg and sued the homeowner and one compensatory damages of over $300,000. this has really happened
