Wow! Rent-A-Cop thinking he has more authority than he actually does. Should've called the cops as soon as the homeless guy didn't want to leave. Now you are in a huge litigation mess/nightmare, not to mention the security company that hired you as well…smh.
I understand the legal nuances here, but I don't agree. The person was asked to leave and didn't. As a security guard, he is responsible for everyones safety. The so-called "victim" has already demonstrated his willingness to take the security guards wepon. I guess we will see.
If it wasn't for that bystander video recording this, the guard may have gotten away with it. The first use of pepper spray if the guy is just sitting there is going to be illegal. Since when can you use pepper spray to enforce a trespass if you are a security guard?
first order of business for security guards is observe and report, without an immediate threat to life, anything beyond that requires police assistance

That was outright murder. He shot the homeless guy because he was angry that he refused to leave. Race could also be a factor.

Yeah, murder charges won't stick here. The guard could easily have been knocked out and then been in mortal danger.

He had no idea how to use his baton, no control holds, and baton retention skills. Unfortunately, the company that hired him did not train him well.
