Can they really be tried for an assault on the officer when this fool was off duty, never produced his badge and acted as a thug waving his gun around and pointing at people just because things got a little intense?
I think this is one of those cases where it's tough to legally justify your spidey senses even if you are right. On the one hand John is technically correct that it wasn't a deadly force encounter , so there may not have been provable justification for the officer to draw his weapon. On the other hand his instinct on these guys was correct that they were willing to get physical with a cop. There's every possibility that had he not drawn his weapon and only identified himself, he would have ended up in the same situation being wrestled down by these guys.
This cop made every single tactical mistake one can make in a defensive scenario. The fact that he is a Sargent leaves a lot to be desired from the NYPD. This might be the dumbest Police officer I have ever seen.

What i saw was attempred aggrevated assualt with a deadly weapon( the car reversing towards the 'victim), leading to destruction of private property(the car window) leading to threats with a deadly weapon and physical assault(by the off duty) leading to self defense of the two victims, leading to assault with a deadly weapon.
