NY defense attorney weighs in on bodega 'self-defense' stabbing

Criminal defense attorney Peter Tilem joins PIX11 Morning News with his thoughts on the controversial case of a Manhattan bodega worker charged with murder for a stabbing that the worker says was in self-defense.

From what I see on the video, it's less clear-cut than with other cases (such as George Zimmerman or Kyle Rittenhouse). It's clear that the criminal was berating the old man hand put hands on, but I think it will depend upon whether it was reasonable for the Bodega clerk to have feared death or grave bodily harm. I hope he can show this, but the video does not make it obvious.

Does the storekeeper have to wait until he is stabbed to death? He is attacked and his life is in danger. Free this man. Protecting yourself when you fear for your life, especially when so much violence is going on all over the city. You cannot wait to decide until what he might kill you, to defend yourself. This man was under attack and he feared for his life. He did not have time to ask the perp what his intentions were. Free this man. Ridiculous. How horrible.

Another important detail that supports self defense is that when the thug on parole was in his counterspace and in his face, the shop keeper never antagonized him or really even acknowledged the thug. He remained quite cool and reasonable until he was attacked.
