I Got Sued for Self Defense with a Concealed Weapon

Anybody can sue you for any reason. Just because your attacker may be dead, his estate or family can still sue you. So killing your attacker for the sole purpose of not getting sued is flawed. Lawyers look at money as the primary reason for the law suit. Unfortunately if you have one of those membership from USCCA or others like them that protects you with money on a civil suit, you are more of a target.

membership in all of the self defense legal services are not all the same. I believe
CCW Safe only provides criminal and civil defense lawyers. No prize is available from them if the original perpetrator prevails civil court.

5kehhn says:

Didn't think about this a great deal, but I guess lawyers gotta make a livin' too.

Doug B says:

This assumes that how your legal bills are being paid is a legally discoverable fact in court, and that someone cares. It also assumes that you are always better off with no insurance and thus are paying all legal fees and court costs out of your own pocket because the assailant's family and lawyer will hopefully base their decisions on being clairvoyant about your estate and personal resources. Hopefully. If I don't have insurance, I'm hard-pressed to figure out how to ante up tens of thousands of dollars just to go to court, hoping that the criminal's family has no desire to drain me dry as punishment. It costs them nothing, since their lawyer only needs to think that it's worth his while either financially or to build his resume or because he's a relative or friend. Should they decide to press a civil suit for whatever reason, logical or emotional, my costs to fight it are covered with insurance. Without it, my lawyer is expecting thousands up front. Where does that come from? In short, it doesn't matter whether you're more of a target. What matters is not going bankrupt and not losing any assets you have just to pay for a successful defense in court. Your choice.

Why is it the law seems to prefer the criminal over the self defender?

NC is one of those states where you get immunity, it falls under the castle doctrine:

"A person who uses force as permitted by this section is justified in using such force
and is immune from criminal prosecution and civil action for the use of such force, unless the
person against whom force was used is a law enforcement officer who was acting in the
performance of his or her official duties and the officer identified himself or herself in
accordance with any applicable law or the person using force knew or reasonably should have
known that the person was a law enforcement officer."

SC Rider says:

Need to understand the family of the dead thief/crook will have to pay zero to hire a lawyer to sue you. The lawyer has nearly zip to lose, cost of filing the suit, varies from state to state, then hope you do not answer the complaint served on you. You will have to hire an attorney, to be sure you dot the eyes and cross the t's. Cost to you, no cost to the family/estate.
