My husband and I have both served on juries before, so we understand the rules jurist must follow, and we both say we self defense. We both would vote him not guilty.
Retired criminal defense attorney here, what we are witnessing here is a classic example of an individual who thought he was in the right based upon his subjective reality, not taking into account the objective actuality of the real world legal system. His demeanor is what may get him convicted, as well as not creating an affirmative defense. If I had to call it, I would say he is convicted of SDM murder, not FDM.
My state is a "stand your ground" state, but was this guy in imminent danger? was this guy truely afraid for his life…. from the video he is hiding the firearm which tells me he was not that afraid….. but i digress, I don't know the whole story… In my eyes, you come on my property, threaten me and your gonna pay the price… but I'm gonna be smart, cover my bases and wait till you come inside my house then they can scrape you up off the floor with a shovel.
Are we going crazy. The so-called victim parks abnormally at his brother and laws house and charges on to his property to attack. The dead person doesn't appear to be a victim i don't care what his brother and law said. This isn't easy open and shut case so what is the debate about for 5 years
Easily self defense. He’s at his home and was charged. You can’t invalidate self defense because he was prepared. Hell, they are dinging him to concealing, they would have flipped the script if he been waving it around also. The is a BS case.
Murder. Premeditated Murder at that. Plenty of better ppl behind bars even now because they didn’t 1. Walk away 2. Call the police or 3. Not be confrontational. A push is not deadly or life threatening harm, so self defense is out the window🤷🏾♂️🤷🏾♂️
It doesn’t matter that the shooter was mouthing-off, it only matters if his gun use was reasonable self-defense. It sure does NOT look to be reasonably necessary from this video clip.
If the shooter provoked him then its not self defense
Not self defense, that’s a coward move.
Self defense

Don't run up on people like a psycho maybe?
Don't smoke meth and attack people and you don't die.

Not self defence, he should have shown that he had a gun.
he was not hiding it behind his back, he pulled it out of his right pocket….they need to pay attention a lot closer…..
