Wisconsin allows open carry under 17 for things like hunting, or training, nothing about the statute is allowing a 17yr old to open carry at a protest/riot LOL

At the 6:35 of the video you state that he had a right to have a firearm but that is in fact not true in the state of Wisconsin. That is what the case will ultimately going to reveal was Kyle Rittenhouse who is a person under 18 in possession of a dangerous weapon. All the other charges stem from that "use of dangerous weapon". I see you kind of skipped over that section.

He will get some time i think but about 5-10 years. I hope it does not come down to a jury's decision. They are useless.

Criminal defense attorney from Wisconsin here. I need to correct one thing here. Under (1m)(ar), one part you missed is that the end of the section it states, "if the actor makes such a claim under sub. (1) AND either of the following applies." The subsections (1) and (2) that follow are mandatory for it to apply. Sub (ar) only comes into effect if the person the force was used on was inside or in the process of entering the actor's abode, place of business, vehicle, etc. It's a Castle Doctrine statute; not a Stand Your Ground statute. Sub (ar), by its own terms simply doesn't apply to this case.

That being said, I think it's still a strong self-defense case just based on sub (1). Even if they wanted to argue that he could have retreated, based on the video, he did attempt to retreat and couldn't*. The state hasn't yet claimed that there was provocation here, but even if they made that argument the fact that he was running away gives him a strong claim that he regained his self-defense privilege under 939.48(2)(b).

*EDIT: I realized that the original wording here may have implied that there is a duty to retreat here. There isn't… however, the jury may consider whether the actor had the opportunity to retreat in determining whether his actions were reasonable. See WI JI-810.

Wow. Kyle is so totally innocent. The most he can get is a misdemeanor for holding the gun in the first place, because he was 17 not 18. But… because he was not allowed the gun, he was shooting it while committing an offense… which means he WILL have to prove that he acted in self defense. Of course, he will be able to do that. But it is a complication.
