Do They Take Your Gun After A Self Defense Shooting?

►[Gun GIVEAWAY] Enter To Win Here: If you’re ever involved in a self-defense shooting, will the police confiscate your weapon? If they do, how long will it take for you to get it back, assuming you are cleared of all charges? In this short informational video, U.S. Concealed Carry Association Director of Content Kevin Michalowski describes what will happen to your gun from the minute the police arrive at the scene of the incident until you (eventually) get it back. 00:00 If you’re ever involved in a defensive shooting incident, the police will probably take your gun into evidence. 00:40 What’s the first thing that will happen at the scene of a self-defense shooting? 00:51 A gun that is used in self-defense becomes a piece of evidence and will be confiscated by investigators. 01:22 You will eventually get your gun back, but it might take a very long time. 01:35 Anecdotally, following the very first case of a self-defense shooting under Wisconsin’s new concealed carry law in 2011, it took the victim more than two years to get his gun back. 01:58 When police confiscate your gun as evidence, do they also take your ammo or other guns you may own? 02:21 Because your gun will be locked up in evidence for a very long time, it may be wise to own a second gun of the exact same make and model since you will already be used to carrying it and have a good holster, magazines, etc. 02:44 What complications could delay you getting a gun back after it is used in self-defense? Do you have any experience having a gun tied up as evidence during an investigation? How long did it take you to get your gun back? USCCA says:

Have you had an incident where the police took your gun?

Jimmy Sauter says:

Who only owns one pistol anyway?? 🤷🏻

Suzuki guy says:

Don't use your gun and it won't be taken

BROKEN MAILMAN says:

So buy more guns! Gotcha! 😀

Scott Heath says:

In 1998 I was convicted of simple assault ,domestic. A misdemeanor with no gun involved but I had a gun in the car. They confiscated it ,took it from me and I NEVER got it back. The police department sent me a letter 9 years later stating that the gun had been destroyed. If you are involved in a justified shooting don't plan on ever seeing that gun again.

Ethan .A. says:

My question is it even worth your time to try and get that firearm back in a non pro 2a area

jwn5 says:

In other words use cheap guns for self and home defense and always keep extras

AniMeyhem! says:

In my state, yes your gun gets seized as evidence for the investigation into the shooting. If the investigation shows you acted lawfully, at the end of the investigation you will get back your weapon. That could take mere days, or weeks, or months depending on how much evidence there is confirming you acted legally. This is why you have a backup to your EDC, and practice with it regularly.
Fun fact, if an officer is involved in an on-duty shooting, HIS gun gets seized as evidence also. He is issued an alternate firearm during the investigation.

Charles Young says:

Us with a self defense shooting: Confiscate gun. Charged with a crime. Have to spend thousands to get name cleared and gun back. (Not mention the civil trial.)
Police with a self defense shooting: Keep gun. Administrative duties with pay. Unions clear your name. (Civil trial, paid for by taxpayers.)

In Whose Opinion says:

Kyle Rittenhouse doesn't have his AR back, Boo-Hoo. Does this channel support Rittenhouse?

Tony Sudano says:

Kyle rittenhouse got his gun back months ago. Except for the fact that he asked the state to destroy it. The judge and da agreed to destroy it for kyle. He wanted it destroyed and not sold.

Edwin O'Keefe says:

That is pure BS. If you admit that you shot someone, why do they need your gun to prove what you have already admitted ! And now if that is your ONLY gun, they have made you a potential victim.
