10 things you should know about Canadian self defense laws

Self-defense is the act of protecting oneself against a real or perceived threat. This usually involves the defender using physical force to detain or stop an attacker from harming them. There are many events that might cause someone to defend themselves, each with their own unique circumstances. These include: • Attempted assault • Attempted rape or sexual abuse • Robbery • Kidnapping or Abduction • Trespassing • Extremely threatening behaviour Though the right to defend oneself can appear straightforward at first, it must be examined on a case-by-case basis. Every year, a number of Canadians are charged with criminal offences such as assault or even manslaughter even though they might believe they were trying to defend themselves. This is due to not fully understanding the limits of their right to self-defence and gravely harming their attacker. Unfortunately, there are many misconceptions about self-defence which can land someone in difficult legal territory without the right support. This is a distortion of the Charter of Rights and Freedoms that the Liberals have weaseled into the Canadian conscience and law over the last few decades. The whole premise of the western mindset of freedom is for and about the individual, NOT THE GOVERNMENT. The Charter states that you have, "the right to life, liberty and security of the person and the right not to be deprived thereof except in accordance with the principles of fundamental justice." The mental gymnastics the government has gone through to arrive at the current distortion of the charter, which basically makes the, "right to life, liberty and security" impossible is nothing less than pathetic. The Charter is toilet paper on so many levels because of the Liberals and needs to completely overhauled and secured against any more intrusions by the left, or right that matter.

Great vid, tx. Important stuff. I was supposed to be a lawyer, I have never been more sorry I didn't go through with that, then this moment. I don't want to rag on well meaning people who have got us to this point, but, sufficed to say, these laws leave a great lot to be desired. They need a complete rewrite, based on, perhaps ancient, but freshly, and staunchly reexamined principles. No one should be subject to the word 'reasonable' when facing incarceration, or any form of denial of one's rights as set out in the Charter. At the very least, the word 'obvious' should be included, and 'reasonable' subject to ANY, even the most minuscule of credence to the victim. Meaning, even if it is highly unbelievable, but still within a realm of possibility, the defender is given the benefit of the doubt.

There is something very wrong with saying, the criminal becomes the defender legally when they meet their match. That is telling criminals they can't lose if they attempt a person to person crime. Unless their victim decides to become a criminal. Completely unacceptable. It's telling people they are required to be legal experts if attacked, if intruders are in your home, with your children and spouse. I'm sorry, no, if I have a weapon at hand I'm deploying it at full force. What should counter any argument of 'reasonableness' is the unknown intentions of these intruders. Even if they say, we don't want to hurt anyone, we just want money. We're supposed to 'trust' a home invader?? Ridiculous.

interesting fact about not being allowed to carry any sort of weapon for self defense here. I did not know that!… That's crazy!… Someone once told me that if you have a bat in the car for protection, make sure you also have a baseball glove and ball to show that you had a logical reason for the bat to be in the car. never just the bat… That's why a tire iron or a socket breaker bar with the proper sized socket for undoing your wheel lugs is also a legitimate item you can expect in a car that can be used as a weapon….as a pedestrian, I imagine a walking stick or a cane is a legitimate item you would/can carry….

Based on experience, doing what's legal won't keep you out of trouble. When my brother attacked me, (I pointed my finger in his face) he punched me in the face & choked me, I did nothing & still got accused. As you can guess, he said I attacked him & he was defending himself to protect his Edm firefighter career. Our Dad only saw me being choked & he backed up my brother. He even blamed a bruise on me even though I never touched him. When my Dad was drunk, he said the cops wanted to come get me & he stopped them. Unless you can video record your whole life, you really should avoid these situations all together because you could end up falsely convicted for defending yourself.

I love Canada but their laws for self defense is in fa or of the criminal and not the victim. American gun laws are so much better. I've had to pull the trigger on someone that was robbing my wife at knife point. I was not charged with anything he is now permanently in a wheelchair and went to prison for 7 yrs . God bless our forefathers who gave us the 2nd amendment!!!!!!

Sometimes I wish we had better laws regarding self-defence. My friend was shot in downtown Toronto and is now paralyzed from the waist down. They had tried to rob us without pulling out their guns first. In return, we did not let them. They didn't like that and shot at us. 1. If we had known the two criminals had guns we would have given up our things immediately. 2. If there were CCW laws implemented in Canada I can almost guarantee that the community would be a lot safer. 3. I think it's an absolute joke that you cannot even carry something as non-lethal as a can of pepper spray to protect yourself, I find it completely insane.

I grew up in a very poverty-riddled area and have seen plenty of drugs, fights, robberies, heard about home invasions, and have been a victim of gun violence firsthand. There are so many flaws regarding self-defence here. There are not too many things I dislike about living in Canada but this is certainly one of them. I personally believe that a right to bear arms for Canadian citizens would greatly decrease the constant rising gun violence. Plenty of politicians believe that Canada is a safe country (and for the most part it is) but they never understand the POV from an average low to middle-class citizen. It is pretty ironic that a rich politician sitting in his upper-class community could ban something he has no need for. I understand that's the way he sees things but that's not the way a lot of people who NEED protection see things. I can assure you that as long as people can pass to and from the USA border to Canada there will always be illegal guns here. It is inevitable to stop, and this is why firearm and AR bans DO NOT TARGET CRIMINALS, they will get them either way. The main problem lies in metropolitan areas like Toronto or Vancouver, where incidents including weapons is on a constant rise. There needs to be a reform or else plenty of citizens who have the same beliefs as me will end up taking a chance. I do not want to resort to carrying things like dog/coyote mace but I have seen so many defenceless people be victimized and I refuse to let myself become a victim.
