Attorney Tom Grieve is a former state criminal prosecutor from Wisconsin before eventually founding what is now the state’s largest criminal defense firm at more than 20 attorneys. A man is approaching you on your own property with a rifle and shoots a shot while advancing and, "The window for prosecution is still open against the home owner" is crazy! The window for the home owner to die was open the moment the guy grabbed a rifle and started advancing.
At step 2 I’m gonna give him 2 seconds to drop it with verbal warnings, then I’m mag dumping. I don’t care if I get 10-30 rather be sentenced by 12 than carried by six.
8 counts of all of that, plus a terrorize charge. And we get 3 seconds during this entire encounter where there’s basically no question on if you’re legally good? This is insane. Dude is angry, advancing, and has a semi auto RIFLE. The laws need to change and fast.
I legally don't give a shit when someone pulls up to my place with a rifle in their hands with the intent to scare/hurt me. I'm pulling out my pistol and dumping my mag in them. In which case I would then remove the rifle from hostile and precede to call 911.
Question. If the man taking the video happened to be a law enforcement officer with a body cam. Would he not have taken the guy out immediately when he got a gun from his truck? I would think that he definitely would have. If so, does a cop have different ROE than a civilian? Thanks
Huh, BS, considering the circumstances leading up to it, once he crosses my property line with that AR he's coming to kill me in my mind. I shoot right then, be serious, you are going to let him draw down on you with a rifle before you shoot? I'll send flowers to your funeral because I will be alive and you most likely won't.
HOWEVER, if you are a cop, you have 100% different rules to follow. Step 1: Shoot him with every round you have available. Step 2: Go into your home and retrieve as much ammo as you can carry. Step 3: Reload your weapon and empty your magazine into vict…. perpetrator. Step 4: Rinse and repeat until you are out of ammo. Step 5: Turn on body cam. Step 6: Claim self defense and lean on qualified immunity.

As soon as the suspect put foot on homeowner’s driveway with rifle in hand the homeowner have every right to shoot the guy
